Terms of Service: Click HereThis Privacy Policy explains how we collect, use, disclose, retain, and protect information when you access or use Battle Boards and related mobile, web, and support services (the "Service"). The Service supports asynchronous climbing matches, ranked and casual play, handles, profiles, friends and invites, public leaderboards, public match history, trophies, board integrations, notifications, and related features.## 1. Scope and Relationship to the TermsThis Privacy Policy applies to the Service and should be read together with the Battle Boards Terms of Service. Capitalized terms not defined here have the meanings given in the Terms.This policy covers personal information and other data collected by us or on our behalf. It does not cover third-party websites, app stores, board manufacturers, gyms, operating-system providers, identity providers, Climbdex, BoardLib, Firebase/Google services as independent controllers where applicable, or other third parties that may have their own privacy practices.## 2. Summary of Key Practices1. Account data. We may collect account identifiers, authentication data, email address, login provider metadata, handle, onboarding status, board capabilities, starting rating bands, and related profile settings.
2. Match and gameplay data. We collect ranked and casual match records, board selections, grades, timers, results, forfeits, Elo/rating values, rating deltas, trophies, leaderboard entries, public match history, and derived competitive statistics.
3. Notifications and invites. We may collect push-notification permission status, FCM/APNs token data, token hashes, platform labels, app version metadata, and invite metadata. The current plan does not use SMS invites or contact-book uploads.
4. Technical and diagnostic data. We may collect device, app, network, log, crash, performance, security, and anti-abuse data.
5. User-generated content. At launch, user-generated content is expected to be limited primarily to handles and similar profile text. Future profile pictures are expected to come from in-app curated selections rather than user uploads.
6. Public or shared data. Handles, profiles, leaderboard entries, trophies, match history, ratings, and other game-derived information may be visible to other users or the public depending on product design.
7. Deletion. If you delete your account, we intend to delete or de-identify the personal user document and account-profile information, but we may retain already shared match records, match-generated data, public competitive records, de-identified data, logs, and other records described below.
8. No sale, ads, or cross-context tracking. We do not currently sell personal information for money, use advertising SDKs, or share personal information for cross-context behavioral advertising. If future advertising, attribution, sponsorship, or monetization creates "sale," "sharing," "tracking," or targeted-advertising obligations under privacy laws or app-store rules, this policy, app-store forms, and consent flows must be updated before launch of those practices.## 3. Information We Collect### 3.1 Information You ProvideWe may collect information you provide directly, including:1. account information, such as email address, password-authentication status, Google or Apple sign-in details made available to us, and account linking information;
2. handle, profile settings, onboarding answers, selected boards, board capabilities, grade/rating bands, and similar in-app preferences;
3. match inputs, climb attempts, selected problems, results, forfeits, challenge parameters, friend actions, invite actions, and support requests;
4. feedback, bug reports, feature requests, moderation reports, inappropriate-handle reports, and other communications sent to [email protected] or [email protected]; and
5. optional body, fitness, or climbing-profile metrics if added later, such as height, sex, ape index, and similar self-reported body metrics used to personalize features, analyze correlations with climbs completed, and improve recommendations; and
6. payment, purchase, subscription, promotion, or prize information if paid features, contests, or promotions are added later.### 3.2 Information Collected AutomaticallyWhen you use the Service, we and our service providers may automatically collect:1. account IDs, Firebase IDs, authentication state, session metadata, timestamps, and security events;
2. device and app information, such as device type, operating system, app version, platform, language, region, and related diagnostic metadata;
3. log, crash, performance, and error data, including Cloud Function logs and app diagnostics;
4. network and approximate technical information, such as IP address as processed by hosting, security, analytics, and infrastructure providers;
5. notification data, including permission status, FCM/APNs tokens, token hashes, token enablement state, token refresh events, and platform labels;
6. usage data, such as screens or features used, matches viewed or created, notification interactions, invite interactions, leaderboard views, profile views, analytics events, crash reports, performance data, and other Service activity; and
7. anti-abuse, fraud-prevention, rate-limit, security-rule, and integrity signals.### 3.3 Match, Rating, and Public Competitive DataWe collect and generate match and competitive data, including:1. match IDs, participant IDs, handles, board IDs, board capabilities, challenge parameters, grade ranges, selected problems, timers, deadlines, statuses, results, winner/loser/draw outcomes, forfeits, and completion metadata;
2. ranked and casual statistics, Elo/rating values, rating deltas, seasonal board stats, casual board stats, all-board aggregated stats, leaderboard positions, public match history, and trophy events;
3. derived metrics, aggregates, eligibility determinations, recommendations, anti-abuse classifications, and other Service Data generated from gameplay; and
4. de-identified, anonymized, or aggregated analytics about boards, grades, match outcomes, player pools, app performance, and product usage.### 3.4 Information From Third PartiesWe may receive information from third parties, including:1. Firebase/Google services used for authentication, Firestore, Cloud Functions, FCM push notifications, Dynamic Links or successor deep-linking products, analytics, crash reporting, security, and hosting;
2. Apple and Google identity providers if you use Sign in with Apple, Google sign-in, or platform account features;
3. app stores and payment processors if purchases, subscriptions, refunds, or promotions are added;
4. Climbdex, BoardLib, board manufacturers, and related problem-data sources for problem catalog metadata that the Service proxies or caches;
5. operating systems and devices for Bluetooth, notification, and permission states; and
6. other users who interact with you through matches, friends, invites, reports, leaderboards, or public profiles.### 3.5 Information We Do Not Intend to Collect Without a Product ChangeBased on the current product plan, we do not intend to collect the following unless a future feature is added and this policy is updated:1. precise GPS location for location-tracking purposes;
2. contact-book uploads or continuous contact syncing;
3. SMS invite sending;
4. free-form direct messages between users;
5. user-uploaded profile photos;
6. health records or medical information;
7. payment-card numbers directly stored by Company; or
8. biometric identifiers used to identify a person, such as faceprints, fingerprints, or voiceprints.Some platform permissions, such as Bluetooth or notification permissions, may expose limited technical signals needed to operate those features. The current iOS configuration includes a Bluetooth usage description and does not declare iOS location usage descriptions. The current Android configuration declares modern Bluetooth scan/connect permissions, marks Bluetooth scanning as neverForLocation, and includes legacy location permissions limited to older Android versions because older Android Bluetooth scanning can require location-related permissions. We do not intend to collect precise GPS location for location tracking.## 4. How We Use InformationWe use information to:1. create, authenticate, maintain, secure, and support accounts;
2. operate ranked and casual matches, timers, forfeits, ratings, leaderboards, trophies, profiles, friends, invites, notifications, and public match history;
3. personalize gameplay, board compatibility, onboarding, problem selection, rating bands, body-metric correlations if added, and product experiences;
4. send transactional, security, account, match, friend, invite, trophy, leaderboard, and support communications;
5. register, refresh, disable, and route push-notification tokens;
6. moderate handles, investigate reports, prevent cheating, enforce competitive integrity, and enforce the Terms;
7. detect, investigate, and prevent fraud, abuse, unauthorized access, security incidents, scraping, spam, and misuse;
8. debug, test, monitor, analyze, improve, and develop the Service;
9. comply with legal obligations, app-store requirements, dispute-resolution needs, law-enforcement requests, and safety obligations;
10. create aggregated, anonymized, or de-identified analytics, benchmarks, reports, product insights, and commercial insights; and
11. support future subscriptions, in-app purchases, promotions, sponsorships, or other monetization if added and disclosed.If body or climbing-profile metrics are added, we will use them to provide user-facing app features, correlations, recommendations, and aggregated product analytics. We do not intend to use self-reported height, sex, ape index, or similar body metrics to identify a person biometrically.## 5. Public and Shared InformationThe Service is competitive and social. Some information is designed to be shared or visible to others, including:1. handles and public profile information;
2. board capabilities or board-related profile details if displayed;
3. ranked and casual match history;
4. ratings, rating changes, wins, losses, draws, forfeits, leaderboard positions, and trophies;
5. friend or invite status where shown by the Service;
6. game-derived statistics and aggregated performance records; and
7. deleted-user placeholders or de-identified records needed to preserve match history and competitive integrity.Do not choose a handle or submit information that you do not want other users or the public to see. Public and shared competitive records may remain visible after account deletion as described in Section 9.## 6. How We Disclose InformationWe may disclose information as follows:1. Other users and the public. We disclose public profiles, handles, leaderboards, trophies, match history, ratings, and game-derived information as part of the Service.
2. Service providers. We disclose information to vendors that host, process, analyze, secure, support, or deliver the Service, including Firebase/Google, app stores, identity providers, push-notification providers, payment processors if added, analytics or crash-reporting providers if enabled, and support tooling.
3. Third-party integrations. We may disclose or receive limited technical and catalog information with Climbdex, BoardLib, board manufacturers, operating systems, Bluetooth devices, and other integrations as needed to provide board or problem features.
4. Legal, safety, and enforcement. We may disclose information to comply with law, legal process, government requests, law enforcement, safety requests, app-store enforcement, Terms enforcement, fraud prevention, security, or protection of rights, property, users, or the public.
5. Business transfers. We may disclose or transfer information in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction.
6. With consent or direction. We may disclose information when you ask us to, when you use a feature that requires disclosure, or when you otherwise consent.
7. Aggregated or de-identified data. We may disclose aggregated, anonymized, or de-identified data for research, analytics, benchmarking, product development, commercial insights, marketing, or other lawful purposes.## 7. Cookies, SDKs, Analytics, and Similar TechnologiesThe Service may use SDKs, local storage, identifiers, cookies on web, and similar technologies to authenticate users, remember settings, support notifications, detect abuse, measure performance, analyze usage, and improve the Service.The current Firebase-first architecture may involve Firebase SDKs and Google infrastructure. If Company enables additional analytics, advertising, attribution, crash reporting, A/B testing, or marketing SDKs, update this policy, app-store privacy disclosures, and any required consent flows before release.## 8. Data RetentionWe retain information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to operate the Service, preserve competitive records, comply with legal obligations, resolve disputes, enforce agreements, prevent abuse, maintain security, and improve the Service.Retention practices may include:1. keeping account data while your account is active;
2. deleting or de-identifying the personal user document and account-profile information after account deletion, subject to technical, legal, security, backup, and legitimate-business limitations;
3. retaining match records, match-generated data, ratings, leaderboards, trophies, public match history, and game-derived records after account deletion because they involve other users and preserve Service integrity, including retaining the handle as already shared on historical match records;
4. retaining notification-token records until they are disabled, expired, deleted, or no longer needed;
5. retaining account-deletion telemetry, security logs, anti-abuse records, support records, and legal records as needed for security, fraud prevention, dispute resolution, and compliance;
6. retaining backups for a limited period before they are overwritten or deleted according to infrastructure practices; and
7. retaining aggregated, anonymized, or de-identified data indefinitely where permitted by law.Unless a longer period is required or permitted for legal, safety, fraud-prevention, dispute-resolution, backup, or security reasons, our general target retention period for support records, deletion telemetry, security logs, anti-abuse records, inactive-account operational records, and similar non-public operational records is 2 years.## 9. Account Deletion and Privacy RequestsYou may request account deletion through in-app tools, if available, or by contacting [email protected]. We may need to verify your identity before fulfilling certain requests.When an account is deleted, Battle Boards intends to delete or de-identify the personal user document and account-profile information associated with the account, including optional body metrics stored in that user document if those metrics are added. However, deletion does not necessarily remove information that has already become part of matches, leaderboards, public match history, trophies, aggregate statistics, logs, anti-abuse records, support records, legal records, or records involving other users. Historical match records may retain the handle that was already shared in those match records.Depending on where you live, you may have rights to request access, correction, deletion, portability, restriction, objection, withdrawal of consent, or appeal. To exercise privacy rights, contact [email protected]. We will respond as required by applicable law.
## 10. Children's PrivacyThe Service is not directed to children under 13, and users must be at least 13 to use the Service. Users under the age of majority may use the Service only with parent or guardian permission and supervision.If we learn that we collected personal information from a child under 13 without legally valid consent, we will take appropriate steps to delete it. Parents or guardians may contact [email protected] with concerns.Because minors may use all current Service features, including friends, invites, public profiles, leaderboards, and public match history, a parent or guardian should review and consent to the Terms and this Privacy Policy for users under the age of majority. The product should avoid displaying personal information beyond handles and game-derived information from played matches. Direct messaging is not planned, and age screening is not currently planned.## 11. International UsersBattle Boards is operated from the United States. If you access the Service from outside the United States, your information may be processed in the United States or other countries where we or our service providers operate. These countries may have privacy laws different from those in your jurisdiction.Before broad launch outside the United States, Company should obtain localized legal review for applicable privacy, consumer, children, data-transfer, marketing, and dispute-resolution requirements.## 12. SecurityWe use reasonable administrative, technical, and organizational measures designed to protect information, including managed Firebase infrastructure, authentication controls, Firestore Security Rules, Function validations, server-side enforcement for sensitive match workflows, token hashing for notification-token document IDs, and access controls.No method of transmission or storage is completely secure. You are responsible for keeping your account credentials and devices secure and for notifying [email protected] if you suspect unauthorized access.## 13. Your Choices and ControlsDepending on available features and platform settings, you may be able to:1. update your handle, profile settings, board capabilities, onboarding choices, and notification preferences;
2. disable push notifications through the app or operating-system settings;
3. sign out or delete your account;
4. report inappropriate handles or profile content from another user's public profile through the in-app report action, which prepares an email to [email protected];
5. opt out of certain marketing communications if marketing communications are introduced; and
6. use platform controls for app permissions such as notifications, Bluetooth, and local device access.Some Service communications, such as security, legal, account, transactional, or operational messages, may still be sent where permitted by law.## 14. Payments, Subscriptions, and PromotionsBattle Boards may add subscriptions, in-app purchases, promotions, contests, sponsorships, or other monetization later. If those features are added, payment and transaction information may be processed by Apple, Google, Stripe, or another payment provider, and Company may receive purchase status, subscription status, transaction IDs, receipts, refund status, region, tax metadata, and related support information.Before paid features or promotions launch, update this policy, app-store disclosures, purchase terms, refund terms, promotion rules, and any tax/payment-provider disclosures.## 15. Changes to This Privacy PolicyWe may update this Privacy Policy from time to time. If changes are material, we will provide notice through the Service, by email, or by other reasonable means. The updated policy becomes effective on the date stated in the updated policy or notice. Your continued use of the Service after the effective date means you acknowledge the updated policy.## 16. If you do not agree, do not use the Service.## 1. Who May Use the Service1. You must be at least 13 years old to use the Service. 5. The Service may be made available outside the United States. If you access the Service from outside the United States, you are responsible for complying with local laws, and some features may not be available or appropriate in every jurisdiction.## 2. Safety, Assumption of Risk, and Climbing DisclaimerClimbing, training-board climbing, bouldering, gym activity, home-wall activity, and related fitness activities involve inherent and significant risks, including falls, equipment failure, overuse injuries, sprains, broken bones, head injury, paralysis, and death.1. The Service is a software tool for organizing, recording, and comparing climbing activity. It does not provide professional coaching, medical advice, safety inspection, route-setting certification, gym supervision, emergency monitoring, or equipment validation.
2. You are solely responsible for your own safety, warmups, spotting, landing-zone checks, pad placement, board angle and hardware checks, equipment selection, rest, physical readiness, and compliance with gym, facility, manufacturer, and local rules.
3. You should consult qualified professionals before beginning or changing any exercise program, especially if you have a medical condition, are injured, are pregnant, or are unsure whether climbing is safe for you.
4. The Service may display climbs, grades, timers, rankings, beta, match prompts, lighting instructions, or other information. That information may be incomplete, inaccurate, delayed, inappropriate for your ability, or unsafe in your environment. Use your own judgment.
5. We are not responsible for injuries, property damage, disputes, facility violations, or other harms arising from climbing, training, board use, Bluetooth-connected devices, user-created activity, or reliance on Service information.## 3. Accounts and Security1. You may need an account to use parts of the Service. You agree to provide accurate information and keep it current.
2. You are responsible for all activity under your account, including matches, handle changes, profile changes, optional body-metric submissions if added, ratings, and challenge submissions.
3. You must keep your login credentials and devices secure and promptly notify us at [email protected] if you suspect unauthorized access.
4. We may use phone authentication, push tokens, device identifiers, and similar technical information to operate authentication, fraud prevention, notifications, and account security.
5. You may not sell, rent, transfer, or share your account except as expressly permitted by us.## 4. The Service and Match SystemThe Service supports asynchronous climbing matches and related social and competitive features, which may include ranked matches, casual matches, timers, results, forfeits, board-specific ratings, leaderboards, public match history, profiles, trophies, friends, invites, daily or weekly problems, problem catalogs, board-lighting integrations, and notifications.1. Ranked matches. Ranked matches may affect board-specific ratings, statistics, leaderboards, trophies, and other competitive records. Rating models may change over time.
2. Casual matches. Casual matches may be recorded for profile, history, trophy, analytics, moderation, and product-improvement purposes, even if they do not affect ranked ratings.
3. Timers and deadlines. Timers, deadlines, expiration rules, forfeits, and match status transitions may be enforced by client software, server systems, or both. We may correct, void, recalculate, or reverse any match result or rating change that we believe is erroneous, abusive, fraudulent, or inconsistent with these Terms.
4. No guaranteed fairness or availability. Match availability, opponent quality, grades, board compatibility, ratings, and leaderboards may be limited by player liquidity, technical constraints, third-party data, and evolving product rules.
5. Public competitive records. Some profile, leaderboard, trophy, rating, and match-history information may be visible to other users or the public, depending on Service settings and product design.## 5. Ownership of Service Data, Match-Generated Data, and AnalyticsThis section is intended to protect Company ownership and use of Service-generated competitive and operational data while respecting users' rights in their personal information and user-submitted content.1. Company-owned Service Data. As between you and Company, Company owns all rights, title, and interest in and to data, records, compilations, metrics, outputs, rankings, derived works, and analytics generated by or through operation of the Service, including match records, match IDs, challenge pairings, timers, submissions, outcomes, forfeits, rating values, rating deltas, leaderboard positions, trophy events, eligibility determinations, anti-abuse signals, aggregated statistics, derived performance metrics, system logs, recommendations, and other data generated from Service interactions (collectively, "Service Data").
2. Match-generated data. Without limiting the prior sentence, Company owns match-generated data, including the structure, organization, compilation, and derived outputs of ranked and casual matches, even when that data is based on your activity or submissions.
3. License from you for inputs. To the extent you have rights in data, text, handles, profile information, optional body metrics if added, climb attempts, results, feedback, or other content you submit or cause to be submitted to the Service ("User Content"), you grant Company a worldwide, non-exclusive, transferable, sublicensable, royalty-free license to host, store, reproduce, modify, adapt, display, publish, distribute, create derivative works from, analyze, and otherwise use User Content to operate, improve, secure, market, and develop the Service and related products.
4. Aggregated and de-identified use. We may create and use aggregated, anonymized, or de-identified data for any lawful purpose, including analytics, benchmarking, product development, commercial insights, research, and publication, provided we do not identify you except as permitted by our Privacy Policy or applicable law.
5. Survival after deletion or termination. The licenses and rights granted to Company for User Content, match submissions, match-generated data, and Service Data survive account deletion, account termination, and your discontinuation of the Service to the extent necessary for Company to operate, preserve, analyze, display, enforce, defend, and improve the Service and to maintain records involving other users.
6. No sale of personal rights by implication. Nothing in these Terms transfers ownership of personal information in a way prohibited by applicable privacy law. Our collection and use of personal information is described in the Privacy Policy.
7. No right to data portability beyond law. We may provide account export or deletion tools where legally required or voluntarily offered, but these Terms do not require us to disclose proprietary algorithms, anti-abuse signals, internal logs, derived analytics, or trade secrets.## 6. User Content and Community StandardsYou are responsible for your User Content and interactions with other users. At launch, User Content is expected to be limited primarily to account handles and similar profile text. Profile pictures, if offered, are expected to come from in-app selections rather than user uploads. We may reject, edit, hide, or remove handles or other profile content, including through automated vetting or manual review. Users may report inappropriate handles or profile content from another user's public profile through the in-app report action, which prepares an email to [email protected] with profile context.You may not submit, send, display, upload, or promote content or behavior that:1. is unlawful, defamatory, harassing, threatening, abusive, hateful, discriminatory, sexually explicit, exploitative, or invasive of privacy;
2. targets, grooms, exploits, or endangers minors;
3. encourages self-harm, unsafe climbing practices, violence, or illegal activity;
4. impersonates another person or misrepresents affiliation, identity, climbing ability, gym affiliation, or match results;
5. infringes intellectual property, privacy, publicity, or other rights;
6. contains malware, spyware, phishing, spam, scams, or deceptive links;
7. manipulates ratings, match outcomes, trophies, leaderboards, invites, reports, or notifications;
8. scrapes, harvests, or exposes other users' personal information without permission;
9. violates gym, board manufacturer, facility, event, league, or competition rules; or
10. otherwise interferes with a safe, fair, and respectful Service.We may remove content, limit visibility, suspend features, terminate accounts, preserve evidence, or report conduct to law enforcement or safety authorities when we believe it is appropriate.## 7. Competitive Integrity and Anti-Abuse RulesYou agree not to:1. submit false results, collude, boost, sandbag, intentionally manipulate ratings, create fake matches, exploit forfeits, share accounts, or otherwise compromise competitive integrity;
2. use bots, scripts, emulators, automation, modified clients, packet manipulation, fake devices, or unauthorized software to access or alter the Service;
3. bypass timers, deadlines, eligibility rules, board restrictions, security rules, payment controls, or rate limits;
4. exploit bugs without promptly reporting them to [email protected];
5. access another user's account, device, or data without permission;
6. overload, attack, probe, scan, or disrupt the Service or related infrastructure; or
7. use the Service in a way that creates unreasonable operational, support, security, or legal risk for Company.We may investigate suspected abuse and may adjust, reset, hide, or delete ratings, match history, trophies, leaderboard entries, account data, or other Service Data.## 8. Intellectual Property and Protection Against Copying1. The Service, including software, source and object code, interfaces, designs, workflows, rating systems, match formats, leaderboard systems, trophy systems, data models, databases, compilations, documentation, text, graphics, trademarks, logos, trade dress, know-how, and other materials, is owned by Company or its licensors and is protected by intellectual property and unfair competition laws.

3. You may not copy, clone, reproduce, modify, translate, adapt, distribute, sell, lease, sublicense, publicly display, publicly perform, create derivative works from, or commercially exploit the Service except as expressly allowed by Company in writing.
4. You may not reverse engineer, decompile, disassemble, inspect network traffic for replication, extract data models, scrape, crawl, harvest, index, benchmark for competitive purposes, train a competing model or system, or otherwise attempt to derive source code, algorithms, architecture, rating models, matching logic, product strategy, non-public features, or trade secrets from the Service, except to the extent a restriction is prohibited by law.
5. You may not use the Service, Service Data, documentation, screenshots, workflows, product concepts as implemented in the Service, or non-public information to build, train, validate, market, or improve a competing product or service without our written permission. These competitive-use restrictions apply to all users unless Company later enters a separate written enterprise, API, beta, partnership, or data license agreement.
6. If you are evaluating the Service on behalf of a competitor, product studio, investor, accelerator, board manufacturer, gym chain, league, or analytics provider, you must disclose that relationship before accessing non-public features or beta programs.
7. Feedback, ideas, suggestions, bug reports, feature requests, and other submissions you provide may be used by Company without restriction or compensation. You grant Company a perpetual, irrevocable, worldwide, royalty-free license to use and exploit that feedback for any purpose.
8. These Terms do not guarantee that every app concept or idea is protectable by contract alone. Company should consider trademark registration, copyright registration for protectable materials, confidentiality practices, trade-secret controls, and patent advice where appropriate.## 9. Third-Party Boards, Gyms, Problem Data, and ServicesThe Service may interact with or reference third-party products and services, including training boards, gyms, operating systems, app stores, Firebase services, notification services, deep-linking services, maps, analytics, Climbdex, BoardLib, Kilter, Tension, MoonBoard, Aurora-compatible lighting systems, Bluetooth devices, and other third-party catalogs, hardware, software, or data sources.1. Company does not own or control third-party boards, gyms, manufacturer apps, problem catalogs, grading systems, hardware, Bluetooth firmware, or app stores unless expressly stated.
2. Third-party names, marks, and data remain the property of their respective owners. Reference to a third party does not imply endorsement, sponsorship, partnership, or approval.
3. Third-party data may be unavailable, inaccurate, incomplete, delayed, cached, rate-limited, changed, or removed. We may modify, cache, proxy, disable, or remove integrations at any time.
4. You are responsible for following third-party terms, gym rules, manufacturer safety instructions, and facility policies.
5. We are not liable for third-party services, content, devices, board malfunctions, connectivity failures, lighting errors, gym conditions, manufacturer changes, or third-party data restrictions.## 10. Communications, Invites, and Notifications1. You agree that we may send transactional, operational, security, account, match, friend, invite, trophy, leaderboard, and support communications through the Service, push notifications, SMS, email, or other channels you provide.
2. Standard carrier rates may apply to SMS or data usage. You are responsible for charges from your carrier or internet provider.
3. You may be able to adjust notification preferences, but some security, legal, and account communications may still be sent where permitted by law.
4. You may not send spam, unwanted invites, deceptive reports, or abusive communications through the Service.
## 11. PrivacyOur Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. By using the Service, you acknowledge our Privacy Policy. If there is a conflict between these Terms and the Privacy Policy regarding personal information, the Privacy Policy controls to the extent required by applicable privacy law.## 12. Optional Body Metrics and Fitness CorrelationsBattle Boards may add optional self-reported body or climbing-profile metrics, such as height, sex, ape index, and similar information. If added, these metrics are intended to be stored in the personal user document, used to personalize the Service, create correlations with climbs completed, improve recommendations, and generate aggregated or de-identified analytics.These metrics are not medical advice, training advice, a health diagnosis, or a guarantee of climbing performance. You should not submit body metrics unless you are comfortable with their use under these Terms and the Privacy Policy. If you delete your account, Company intends to delete or de-identify body metrics stored in the personal user document, while retaining match-generated data and already shared match records as described in these Terms and the Privacy Policy.## 13. Payments, Subscriptions, and PromotionsBattle Boards may add subscriptions, in-app purchases, or other paid features in the future. Until paid features are launched, this section is a future-ready placeholder for attorney and app-store review.1. Paid features, subscriptions, in-app purchases, or promotions may be subject to additional terms presented at purchase.
2. App store purchases are processed by the applicable app store and may be governed by Apple, Google, or other platform terms.
3. Fees are non-refundable except as required by law or expressly stated in applicable purchase terms.
4. We may change pricing, features, or availability prospectively, subject to applicable law and app store rules.
5. Sweepstakes, contests, leagues, prizes, or promotions must have separate official rules and are void where prohibited.## 14. Beta, Experimental, and Pre-Release FeaturesWe may offer beta, experimental, or pre-release features. They may be incomplete, unstable, confidential, inaccurate, or discontinued at any time. You may not disclose non-public beta features, screenshots, performance information, data models, or product plans without our written permission.## 15. Service Changes, Availability, and Data Retention1. We may modify, suspend, discontinue, or limit any part of the Service at any time, including features, match rules, ratings, supported boards, integrations, trophies, leaderboards, public profiles, and data retention periods.
2. We do not guarantee that the Service will be uninterrupted, secure, error-free, compatible with every device, or available in every region.
3. We may retain, delete, aggregate, anonymize, or archive data as described in our Privacy Policy, operational practices, and legal obligations.
4. We may impose limits on storage, requests, matches, invites, notifications, or other usage.## 16. Account Termination, Suspension, and Self-DeletionYou may stop using the Service at any time and may request account deletion through the in-app tools, if available, or by contacting [email protected].We may suspend, restrict, disable, or terminate your account or access to all or part of the Service at any time, with or without notice, if we believe you violated these Terms, created risk, infringed rights, abused other users, compromised competitive integrity, caused operational issues, exposed Company to legal liability, or otherwise acted inconsistently with the safety, fairness, integrity, or intended operation of the Service. To the maximum extent permitted by law, we also reserve the right to suspend, restrict, disable, or terminate any account or access to the Service for any reason or no reason, in our sole discretion.If you self-delete your account or we terminate it:1. your license to use the Service ends immediately;
2. we may delete or de-identify the personal user document and account-profile information associated with your account, subject to technical limitations, legal requirements, fraud prevention, safety, dispute resolution, backup retention, and legitimate business needs described in the Privacy Policy;
3. deletion of your personal user document does not require Company to delete Service Data, match-generated data, ratings, leaderboards, trophies, aggregated data, de-identified data, system logs, anti-abuse records, or records needed to preserve matches and histories involving other users;
4. content or data you already shared through matches, public profiles, leaderboards, trophies, invites, or other multi-user features may remain visible, archived, de-identified, attributed to a deleted-user placeholder, or otherwise retained as needed to preserve the integrity and history of the Service;
5. Company retains the ownership, licenses, and rights described in these Terms for already shared content, handles already shared on historical match records, match submissions, match-generated data, and Service Data, including the right to host, display, analyze, aggregate, commercialize, and create derivative works from that data as permitted by these Terms and applicable law;
6. we may refuse future account creation or access if we previously terminated or restricted you; and
7. sections that by their nature should survive will survive, including ownership, licenses, disclaimers, limitations of liability, indemnity, dispute resolution, and general terms.## 17. Copyright and Intellectual Property ComplaintsIf you believe content on the Service infringes your copyright or other intellectual property rights, contact [email protected] with:1. your name and contact information;
2. identification of the work you claim is infringed;
3. identification of the allegedly infringing material and where it appears;
4. a statement that you have a good-faith belief the use is not authorized;
5. a statement that the information is accurate and, under penalty of perjury where applicable, that you are authorized to act for the rights owner; and
6. your physical or electronic signature.We may remove content and terminate repeat infringers where appropriate.## 18. 2. MATCHES, RATINGS, GRADES, LEADERBOARDS, TROPHIES, TIMERS, NOTIFICATIONS, OR PROBLEM DATA WILL BE CORRECT;
3. THE SERVICE WILL PREVENT INJURY, CHEATING, HARASSMENT, UNSAFE CLIMBING, OR THIRD-PARTY MISCONDUCT;
4. THIRD-PARTY BOARDS, GYMS, PROBLEM DATA, BLUETOOTH DEVICES, APP STORES, OR CLOUD SERVICES WILL FUNCTION PROPERLY; OR
5. DEFECTS WILL BE CORRECTED.Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.## 19. 6. your fraud, misconduct, cheating, harassment, or unsafe activity.We may control the defense of any matter subject to indemnification, and you agree to cooperate with us.## 21. Dispute Resolution, Arbitration, and Class Action Waiver1. Informal resolution first. Before filing a claim, you agree to email [email protected] with your name, account identifier, a description of the dispute, and the relief requested. The parties will try to resolve the dispute informally for 30 days.
2. Binding arbitration. Except for excluded claims below, disputes arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its consumer arbitration rules.
3. Excluded claims. Either party may bring claims in small-claims court if eligible. Company may seek injunctive or equitable relief in court to protect intellectual property, confidential information, security, Service integrity, or unauthorized access.
4. No class actions. Disputes must be brought only on an individual basis and not as a plaintiff, class member, or representative in any class, collective, consolidated, private-attorney-general, or representative action.
5. Opt-out. You may opt out of arbitration within 30 days after first accepting these Terms by emailing [email protected] with your name, account identifier, and a statement that you opt out of arbitration.
6. Governing law and venue. These Terms are governed by the laws of North Carolina, United States, excluding conflict-of-law rules. If a dispute is not subject to arbitration, the exclusive venue will be the state or federal courts located in North Carolina, and both parties consent to personal jurisdiction there.## 22. App Store Additional TermsIf you download the Service from Apple's App Store, Google Play, or another app marketplace, the applicable marketplace terms also apply. The marketplace provider is not responsible for the Service, support, claims, injuries, maintenance, or warranty obligations except as required by its own terms or applicable law. You must comply with all applicable third-party terms when using the Service.## 23. Export, Sanctions, and Legal ComplianceYou may not use, export, re-export, or transfer the Service except as authorized by applicable law.
